Terms and Conditions
Jumping Janx & Company, LLC
Effective Date: October 5, 2026
These Terms and Conditions ("Terms") are a legal agreement between you and Jumping Janx & Company, LLC ("Jumping Janx", "we", "us", "our"). They govern your access to https://jumpingjanx.com (the "Website") and your purchase of our toy and game board and any related products we offer (the "Products"). Please read them carefully before you use the Website or place an order.
1. Agreement to These Terms
By accessing the Website, or by placing an order, you agree to be bound by these Terms, our Privacy Policy, our Cookie Policy and our Refund and Returns Policy, all of which are available on the Website and form part of this agreement. If you do not agree, please do not use the Website or place an order.
2. About Us and the Website
Jumping Janx & Company, LLC is a limited liability company registered in the State of New York, United States. We sell the Products directly to customers through the Website. Our contact details are in section 25.
3. Eligibility
You must be at least 18 years old and able to form a binding contract to place an order. If you are buying a Product as a gift for a child, you, as the adult purchaser, are responsible for the child's use of it in line with section 10. We may refuse service to anyone at our reasonable discretion, subject to applicable law.
4. Products and Product Information
We try to describe and display the Products accurately, including photographs, dimensions, contents and age recommendations. Colors on your screen may vary from the actual Product. Small variations may occur and do not make a Product defective. We may change or discontinue any Product at any time.
5. Orders and Acceptance
a. When you place an order, you make an offer to buy the Products in your cart. We send an order confirmation email to acknowledge that we have received it. That email is not our acceptance.
b. A contract between you and us is formed when we ship your order and send you shipping confirmation, or when we otherwise confirm that we have accepted it.
c. We may decline or cancel an order, in whole or in part, for reasons that include a Product being unavailable, a pricing or description error, a suspected fraudulent or unauthorized transaction, or a problem with your payment. If we cancel an order after payment, we will refund you in full.
d. You must give us accurate, complete and current information when ordering, including your name, email address, shipping address and billing address.
6. Prices, Payment and Taxes
a. Prices are shown in United States dollars and may change at any time. The price that applies to your order is the price shown when you complete checkout.
b. Payment is taken at checkout through Shopify and its payment gateways. You confirm that you are authorized to use the payment method you provide. We do not receive or store your full payment card number.
c. Applicable sales and use taxes are calculated and added at checkout where required by law.
d. If a pricing error is discovered, we may correct it and give you the choice of confirming the order at the correct price or cancelling it for a full refund.
7. Free Delivery
a. We offer free delivery on orders placed through the Website. Free delivery may be changed or withdrawn for future orders, but it will apply to the order you place if it is shown at checkout.
b. Our fulfillment center ships orders using UPS. Delivery times shown are estimates only, and we are not liable for delays caused by UPS, weather, customs or other events outside our reasonable control, subject to applicable law.
c. Risk of loss or damage passes to you when the carrier delivers the Product to the address you gave us. If your order arrives damaged, or does not arrive, please contact us promptly at support@jumpingjanx.com so we can help. Please make sure your address is accurate. We are not responsible for orders that cannot be delivered because of an incorrect or incomplete address that you provided.
8. Returns and Refunds
You may return a Product within 30 days of delivery for a refund, for any reason, in line with our Refund and Returns Policy, which is available on the Website and is incorporated into these Terms. In summary, the Product must be returned in its original condition and packaging, you must provide proof of purchase, and you pay the cost of returning a Product that is not defective. If the Product is defective or damaged on arrival, or is not the Product you ordered, we pay for the return. If these Terms and the Refund and Returns Policy conflict on a refund matter, the Refund and Returns Policy applies.
9. Cancelling an Order
You may ask us to cancel an order before it ships by contacting support@jumpingjanx.com as soon as possible. We will cancel it and refund you in full if we can do so before it leaves our fulfillment center. After shipping, please use the return process in section 8.
10. Safe Use of the Products
The Products are toys and games. You must follow all age recommendations, warnings, instructions and safety information supplied with a Product or shown on the Website. Some Products may contain small parts. Children should be supervised by a responsible adult while playing, and the Products should be kept away from children who are too young for them. Please stop using a Product and contact us if it appears broken or unsafe.
11. Disclaimer of Warranties
Except as expressly stated in these Terms or required by law, the Website and the Products are provided "as is" and "as available". To the fullest extent permitted by applicable law, we disclaim all other warranties, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Website will be uninterrupted, secure or error free. Some jurisdictions do not allow the exclusion of certain warranties, so some of this section may not apply to you. Nothing in these Terms limits any right you have under applicable consumer protection law that cannot lawfully be excluded, including any right to a remedy for a defective Product.
12. Limitation of Liability
a. To the fullest extent permitted by applicable law, we, and our members, managers, employees, contractors and service providers, are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profits, revenue, data or goodwill, arising out of or relating to the Website or the Products, even if we have been told they are possible.
b. To the fullest extent permitted by applicable law, our total liability for any claim arising out of or relating to the Website, an order or a Product is limited to the amount you paid us for the Product that is the subject of the claim.
c. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud, or for death or personal injury caused by our negligence, where the law does not allow it to be excluded. Some jurisdictions do not allow certain limitations, so some of this section may not apply to you.
13. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Jumping Janx & Company, LLC, and its members, managers, employees and service providers, from claims, losses, liabilities and reasonable expenses, including reasonable legal fees, arising out of your breach of these Terms, your misuse of the Website, or your misuse of a Product contrary to its instructions and warnings. We will tell you promptly about any claim that we expect you to cover, and you must cooperate with us in dealing with it.
14. Intellectual Property
The Website and its content, including text, images, graphics, photographs, video, game rules, the design of the toy and game board, and the software that runs the Website, are owned by us or our licensors and are protected by copyright, trademark and other intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to view the Website and its content for your personal, non-commercial use, and to use the Products you buy for their intended purpose. You may not copy, reproduce, modify, distribute, sell, or create derivative works from the Website or the Products, or use them for commercial purposes, without our prior written permission. All rights not expressly granted are reserved.
15. Trademarks
"Jumping Janx", and our logos and product names, are trademarks or trade names of Jumping Janx & Company, LLC or its licensors, whether or not registered. You may not use them without our prior written permission. Other names and marks that appear on the Website belong to their owners.
16. Acceptable Use of the Website
You agree not to:
a. use the Website for any unlawful, fraudulent or misleading purpose, including submitting a false refund or delivery claim;
b. interfere with or disrupt the Website, its servers or its security, or try to gain unauthorized access to any part of it;
c. use bots, scrapers or other automated tools to access the Website or collect data from it without our permission;
d. introduce viruses or other harmful code; or
e. use the Website to resell Products commercially without our written consent.
17. Messages and Submissions You Send Us
If you send us a message, feedback, a suggestion or an idea through the contact page or by email, you grant us a non-exclusive, royalty-free, worldwide, perpetual license to use it to run and improve the Website and the Products, without obligation to you. You must not send anything that is unlawful, abusive, or infringes anyone else's rights.
18. Marketing Communications
If you sign up for, or agree to receive, marketing emails, we may send you emails about the Products and offers. We use Klaviyo to send them. You may unsubscribe at any time using the link in any marketing email or by contacting support@jumpingjanx.com. We will still send you messages about your orders and any messages we are required by law to send.
19. Privacy and Cookies
Our Privacy Policy explains how we collect and use personal information, and our Cookie Policy explains how we use cookies and similar technologies. Both are available on the Website. By using the Website you acknowledge that you have read them.
20. Third-Party Services and Links
The Website uses third-party services, including Shopify for hosting, checkout and payments and Klaviyo for email marketing, and delivery is carried out by UPS. The Website may also link to other websites. We do not control third-party services or websites and are not responsible for their content, availability or practices. Your use of them is subject to their own terms and privacy policies.
21. Events Outside Our Control
We are not liable for any delay or failure to perform our obligations caused by events outside our reasonable control, including natural disasters, severe weather, fire, epidemic, war, terrorism, labor disputes, supplier or carrier failures, interruptions to internet or utility services, or acts of government. If such an event continues for a long period, either of us may cancel the affected order, and we will refund any amount you paid for a Product we have not delivered.
22. Website Availability and Changes
We may change, suspend or discontinue the Website or any part of it at any time. We may update these Terms from time to time by posting the updated version on the Website and changing the effective date above. The Terms in effect when you place an order apply to that order. Your continued use of the Website after we post an update means you accept the update, to the extent the law allows.
23. Governing Law, Disputes and Venue
a. These Terms, and any dispute or claim arising out of or relating to them, the Website or the Products, are governed by the laws of the State of New York and applicable United States federal law, without regard to conflict of law principles. This does not remove any mandatory consumer protection rights you have under the law of the place where you live.
b. If you have a dispute with us, please first contact us at support@jumpingjanx.com and give us a reasonable opportunity, of at least 30 days, to resolve it informally. Most concerns can be settled this way.
c. If a dispute is not resolved informally, it will be brought in the state or federal courts located in the State of New York, and you and we consent to the personal jurisdiction of those courts. Either of us may bring an eligible claim in small claims court in the place where you live or where we are located. Where mandatory law gives you the right to bring a claim in another court, that right is not affected.
24. General Provisions
a. Severability. If any provision of these Terms is found to be invalid or unenforceable, the rest remains in effect, and the provision will be enforced to the greatest extent permitted.
b. No waiver. A delay or failure by us to enforce any right does not waive it.
c. Assignment. You may not assign or transfer your rights or obligations under these Terms without our written consent. We may assign ours to a successor to our business.
d. Entire agreement. These Terms, together with the policies referred to in section 1, are the entire agreement between you and us about the Website and the Products, and replace any earlier understanding on those subjects.
e. Notices. We may give you notices by email to the address you provided or by posting on the Website. You may give us notice by email to the address in section 25.
f. Headings. Headings are for convenience only and do not affect interpretation.
